This Privacy Policy explains how Business Capital Solutions Pty Ltd (ACN 630 676 890) (“BCS”, “We”, “Us” or “Our”) collects, discloses, uses, stores or otherwise handles personal information for the purposes of operating the business and providing our businesses services.

BSC is a business-to-business lending service specialising in a range of industries covering Plant Machinery Finance, Equipment Finance, Business To Business Lending and Property Development Lending.

When we refer to ‘you’ or ‘your’ in this policy, we may be referring to you who engages us for information about our services or for our services, or to potential investors who wish to lend via BCS as intermediary. This policy is not limited to current customers or guarantors of customers (where applicable) – it relates to all other individuals who deal with us, whether in relation to the provision of our services or otherwise. By using our services or otherwise dealing with us, you agree to this Privacy Policy.

Personal information collected by us is handled subject to the Privacy Act 1988 (Cth) (“Privacy Act”) and the Privacy (Credit Reporting) Code 2014. This policy is published in accordance with Australian Privacy Principles (APPs) in Schedule 1 of the Privacy Act.

We only collect, use, and disclose personal information where this is permitted by the Privacy Act and for the purposes outlined in this Privacy Policy.

Specific information about the personal information we collect, use, and disclose to carry out our business activities and provide our services is outlined below.

BCS reserves the right to make changes or updates to this Privacy Policy from time to time. If this happens, we will update this Privacy Policy on our website.

We collect information about you and your interactions with us, for example, when you enquire, apply for, request or use our products or services, make a card payment or transfer money, phone us or visit our website.

We will collect certain personal information about you depending on the circumstances in which the product or service is being applied for or provided. We may collect information about you from others such as service providers, agents, your bank, advisers, brokers, employers or family members.

When you contact us or when others contact us on your behalf to enquire about our services, and when you (or someone on your behalf) submit a credit application form to us, we may collect your personal information.

  • your and/or the other person’s name

  • contact details

  • date of birth

  • banking details

  • financial and related information, such as your occupation, accounts, bank account, assets, expenses, income, revenue, dependents, your employment, financial and business dealings and other relevant events;

  • evidence of identity information or documentation, including a copy of your driver’s licence

  • the name of your current (or last known) employer

  • your credit history

  • your repayment history

  • financial hardship information

  • any court judgement made against you that relate to credit provided to you

  • the properties of which you are registered proprietor (whether sole proprietor or jointly with others)

  • your directorship (if applicable) of any Australian registered companies;

  • the Personal Property Securities Register charges against you personally or in your capacity as director of a borrowing company (if applicable)

  • other information reasonably necessary to review your credit worthiness.

By contacting us via phone call, correspondence or submitting your personal information via the BCS website, and by otherwise engaging us for our services, you consent to the collection of your personal information. This may include information collected directly from you and information that you authorise us to collect from third parties.

It is not mandatory for you to provide us with the personal information that we request – however if you do not do so it may affect the products and services that we can provide to you.

3. Why we collect and how we use personal information

We collect and use your information to:

  • verify your identity and assess applications for products and services;

  • determine your eligibility for, and comply with our obligations under, the Australian Government schemes (if applicable);

  • price and design our products and services;

  • administer our products and services, including assessing whether to make any future offer to you, and generally carry out our business functions;

  • manage our relationship with you, including fulfilling our obligations and exercising our rights under any agreement with you;

  • conduct and improve our businesses and improve our customers’ experience;

  • manage our risks and help identify and investigate illegal activity, such as fraud;

  • contact you, for example following a third party referral or request from you or to invite you to review our products and services;

  • comply with our legal obligations; and

  • for the provision of products or services offered by us and for billing purposes.

We may also collect, use and share your information in other ways where you have authorised us to do so or where permitted by law.

If you provide any personal information to us about another person, you confirm that you have the authority of that person to share their information with us and to permit us to hold, use and disclose their information in accordance with this Privacy Policy. You must inform them of their rights to access and request correction of their information set out below.

We may share your information with third parties where this is permitted or required by law, or when it is reasonably required to achieve any of the purposes mentioned in section 3 above.

  • your co-applicant(s) (if any);

  • entities that provide services to us such as, identity verification, mailing houses or call centre operators;

  • service providers, for example law firms, accountants, consultants, auditors and insurers representing us or you or your related entity;

  • service providers to whom we outsource certain functions, for example, statement production, debt recovery and information technology support, some of whom may contact you on our behalf;

  • brokers, agents and advisers and persons acting on your behalf, for example guardians or persons holding power of attorney;

  • guarantors or any person providing security for any service;

  • persons involved in arrangements that provide funding to us and indirectly to you;

  • claims-related providers, such as assessors and investigators, who help us with claims;

  • other financial institutions such as banks and credit providers or their authorised representatives or partners, or another third-party organisation or partner, including where such entities provide products and/or services that may reasonably be of interest to you;

  • entities established to help identify illegal activities and prevent fraud; and

  • any other parties that you authorise or that we are required or permitted by law to share information with.

However, for each of the above circumstances, we will only disclose the amount of information necessary for the relevant purpose.

6. Storage and security of personal information

The protection of your personal information is something we take very seriously, and we are committed to keeping it secure. We take precautions to protect personal information from misuse and loss, and from unauthorised access, modification, or disclosure.

We store your hard-copy or electronic records on our premises and systems or offsite using trusted third-party cloud-based infrastructure. We use reasonable endeavours to keep your personal information secure, however, this security cannot be guaranteed.

All information is stored securely and electronically in our centralized storage system.

Email accounts and cloud accounts which store your information are protected from unauthorised access by way strong authentication and password protection processes.

We have protection in our office against unauthorised access such as locks, alarms and cameras.

We use reasonable endeavours to keep information only for as long as required (for example, to meet legal requirements or our internal needs).

7. Collecting through our website

We will collect your personal information if you provide it when using the BSC website. We will use and disclose this information for the purpose for which you provided it.

The BCS website uses Google Analytics to help us continually improve the user experience.

Google Analytics is hosted by a third party. We use Google Analytics to collect data about your interaction with our website. The type of data that we may collect includes:

Other than via the above, BSC will not disclose personal information to anyone outside Australia without need and without your consent.

Under the Privacy Act, you have a right to access the personal information we hold about you. Please contact us via any method set out in clause 11 below if you seek access to your information.

If you consider the personal information we hold that is about you is not accurate, complete, or up to date, please contact us as soon as possible for assistance and correction.

10. How to make a complaint

If you wish to complain to us about how we have handled your personal information please write to us by sending your enquiry or complaint by email to admin@businesscapitalsolutions.com.au. Please address your correspondence to ‘The Privacy Officer’. If you need help lodging a complaint, you can contact us - see ‘How to contact us’ below at clause 11.

If we receive a complaint from you about how we have handled your personal information, we will review the complaint as soon as possible and determine what, if any, action we should take to resolve the complaint. We will tell you promptly that we have received your complaint and then respond to the complaint within 30 days.

If you are dissatisfied with the outcome of the complaint or the way in which the complaint was handled, you may contact the Office of the Australian Information Commissioner (“OAIC”) for advice about your complaint by calling them at 1300 363 992, online at www.oaic.gov.au or writing to OAIC to GPO Box 5218 Sydney NSW 2001.
